General Terms and Conditions of Sale
1. Scope and Purpose These General Terms and Conditions of Sale set out the agreement between AUDENTIA CONSEIL, operating as Lykos Galerie (hereafter the "Gallery"), and the individual or legal entity acquiring an artwork (the "Buyer"). By placing an order on this website, the Buyer acknowledges and accepts these Terms without restriction or reservation.
2. Artworks and Descriptions The gallery specializes in works on paper and objects spanning from antiquity to the 21st century. Every work is accompanied by a detailed description and a digital condition report. While the gallery endeavors to represent works as accurately as possible, photographs and reproductions are for informational purposes only and do not have contractual value. All statements regarding authenticity, date, and provenance constitute the gallery's professional judgment and opinion only and are not warranted as absolute facts.
3. Order Validation and Finality An order is deemed accepted and the sales contract valid only once the gallery has issued an order confirmation via email and the full purchase price has been received. For all orders delivered outside the European Union, sales are considered final upon confirmation. Pursuant to Article L.221-18 of the French Consumer Code, individual consumers within the EU have a 14-day right to retract their purchase from the date of receipt.
4. Pricing and Payment Prices are displayed in Euros (€), inclusive of all applicable French taxes but excluding delivery costs. We accept major credit cards (Visa, Mastercard, and American Express) and bank transfers. Full legal title to the artwork remains with the gallery until the purchase price and all associated fees are paid in full.
5. Shipping and International Customs Orders are typically processed within 1 to 3 business days. For deliveries outside the EU, the Buyer is the importer of record and is solely responsible for all customs duties, local taxes, and import formalities. The Buyer must inspect the package upon receipt and report any damage to both the carrier and the gallery within 48 hours.
6. Legal Warranties and Intellectual Property Artworks benefit from the legal guarantee of conformity and the legal guarantee against hidden defects under French law. The acquisition of an artwork does not grant the buyer any rights of reproduction or representation. The artist or their estate retains all intellectual property rights. In accordance with global regulations, the gallery may be required to conduct Customer Due Diligence (CDD) for transactions exceeding €10,000.
7. Governing Law and Jurisdiction These Terms are governed by French law. Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Paris.
