Terms of Service: Conditions of Acquisition

Article 1 – Purpose and Scope

These General Conditions of Sale (the "Terms") govern all transactions and acquisitions made through the Lykos Galerie online platform, website: www.lykosgalerie.com. By accessing the Site or initiating an acquisition, the client acknowledges and accepts these Terms without restriction or reserve.

  • Target Audience: These Terms apply to individual consumers and legal entities globally.

  • Collection Focus: The gallery specializes in works spanning from antiquity to the 21st century.

Article 2 – Identification of the Offeror

The artworks are offered by the parent entity of Lykos Galerie:

  • Entity: Audentia Conseil SARL / Lykos Galerie, a limited liability company ("société à responsabilité limitée") with equity established at EUR 1,000, listed under the Paris Trade and Companies Register under number 940.875.594, with a head office located at 143, rue d'Aboukir 75002 Paris - Telephone number: +33 (0)6.74.94.96.34 - email: contact@lykosgalerie.com

  • Registered Office: Located in Paris, France.

  • Legal Standing: Registered with the Registre du Commerce et des Sociétés (RCS) of Paris.

Article 3 – Artworks and Condition Reports

  • Historical Accuracy: Detailed information regarding the definition, properties, and characteristics of each work is available on the site.

  • Visual Representation: Photographs and digital reproductions are indicative and do not hold contractual value.

  • Mandatory Documentation: Given the age of works ranging from the 17th to the 21st century, a digital condition report is provided for every item prior to the finalization of the sale.

Article 4 – Order Process & Finality

  • Capacity: To place an order, the client must be of legal age and possess the legal capacity to enter into a contract.

  • Availability: Orders are accepted within the limit of available stock.

  • Finality (International): For clients outside of the European Union, all sales are considered final upon payment due to the archival risks associated with international transit.

Article 5 – Pricing and Ownership

  • Currency: Prices are indicated in Euros (and optionally US dollars) and include all applicable taxes (TTC), excluding shipping fees.

  • Retention of Title: Artworks remain the exclusive property of the gallery until full payment of the purchase price and associated taxes/fees is received.

Article 6 – Delivery and Logistics

  • Handling: Delivery is conducted via specialist art handlers and "white-glove" services.

  • Address Restrictions: Deliveries cannot be made to hotels or P.O. boxes.

  • Risk: Risk of loss passes to the client upon delivery to the indicated address.

Article 7 – Right of Withdrawal (EU/France)

  • Statutory Right: In accordance with Article L.221-18 of the French Consumer Code, EU-based consumers have 14 calendar days from receipt to exercise their right of withdrawal.

  • Archival Integrity: The work must be returned in its original packaging and in perfect condition. Any handling beyond what is necessary to establish the nature of the work may void the refund.

  • Administrative Fee: Authorized returns outside the statutory EU window are subject to a 15% restocking and conservation fee.

Article 8 – Intellectual Property

  • Exclusivity: All logos, illustrations, images, and trademarks appearing on the site or in the works remain the exclusive property of the Gallery.

  • Rights: Acquisition of an artwork does not transfer any rights of reproduction or commercial exploitation to the client.

Article 9 – Applicable Law and Jurisdiction

  • Governing Law: These Terms are subject to French law.

  • Disputes: Any litigation related to the interpretation or execution of these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, without prejudice to mandatory consumer protections in the client's country of residence.
